12 4.4 System standards The Operator will: (a) ensure that the organisation, playing and conduct o f approved games is always in accordance with the rules, procedures and equipment approved by the Director; (b) comply with and observe the provisions of Commonwealth Gaming Legislation; (c) ensure that the computer system and control system are maintained at or above the standard approved by the Director; (d) comply with any direction given by the Director to change the approved control system under regulation 11 of the Regulations; (e) take all reasonable measures to regularly identify and utilise the prevailing commercial standards o f technical security, performance and privacy in relation to information technology and e-commerce; (f) inform the Director o f all technological advancements material to the conduct of gaming that the Operator becomes aware of in relation to information technology and e-commerce; A.(g) introduce, at the Director's request, any new business practices or initiatives that the Director reasonably believes will contribute positively towards the better conduct o f the internet gaming business; and (h) ensure that at all times the computer system and the control system utilise state of the art technology. 4.5 Conduct standards The Operator will: (a) conduct the internet gaming business in a responsible and reputable manner; (b) comply with and observe all laws as they apply to the Operator relating to the licence; (c) subject to section 47H of the Control Act, comply with and observe the provisions of every statute, including without limitation the Control Act as amended from time to time, and every rule, regulation, ordinance and by-law made or to be made under any statute; (d) comply (at the Operator's expense) with all notices received from any statutory authority or public authority relating to the performance of this agreement, including without limitation, any direction given by the Director; (e) ensure that at all times whilst any activity in any way related to the internet gaming business is being carried out at an approved location that the number of key employee licence holders present and on duty shall not be less than the number required under the approved control system; DRWDOCS\COULTSI\26019.13
