11 DECISION TO ISSUE A CERTIFICATE I acknowledge and respect the traditions and beliefs of Aborigines and custodians regarding the significance of sites in the area of the proposed dam. I am also acutely aware of the NT Government's responsibility to the community as a whole, including the Aboriginal members of the community. There is a clear need to have regard to potential loss of life and damage to property in the event that no steps are taken to mitigate floods in the Alice Springs region. Applied to the subject of the present application, I take into account the fact that the proposed dam would adversely affect one particular Aboriginal site and some river gum trees, but otherwise would have minimal impact on other sites in the area. In my judgment as the responsible Minister, the need to protect life and property outweighs the desirability of protecting one particular site and some trees of significance. After considering the above matters and having carried out discussions of the Protection Authority's report and recommendations with the applicant, custodians and other persons or bodies, pursuant to section 32(l)(b) of the Act I have issued a Certificate to allow the construction of a flood mitigation dam for Alice Springs and in accordance with the application made by the applicant on 22 May 1991, on conditions specified in that Certificate.
