26 Subject to clauses 10.2 and 10.3 the Operator consents to the disclosure by the Minister, in the manner contemplated in clause 10.4 of any information about the Operator's internet gaming business, in addition to the information referred to in that clause, if it is information of the kind released by government agencies and departments in the other States and Territory o f Australia or of the Commonwealth in order to facilitate research into problem gambling and to ensure a sound gaming policy is developed in the Territory and throughout Australia. 11. AGENTS 11.1 Definition of Agent For the purposes of this clause, 'Agent' means a person that is appointed by the Operator in accordance with this agreement and who carries out any o f the following functions for the Operator: (a) registering a player; (b) establishing a player's account; (c) accepting deposits for, or authorising withdrawals from, a player's account; or (d) any other functions identified in the approved control system or nominated by the Director in writing to the Operator. 11.2 Agent criteria The Operator may only appoint a person as an Agent if the appointment is made under an Agency Agreement and the person is in the case of an individual: (a) is at least 18 years o f age; (b) is! of good repute having regard to character, integrity, honesty and responsibility; (c) has a sound and stable financial background; (d) has, subject to the Criminal Records (Spent Convictions) Act, not been found guilty of an offence involving dishonesty since he or she attained the age of 18 years, an offence against the Control Act or o f an offence which is punishable on conviction by a maximum penalty of not less than 5 years imprisonment; (e) is, by reason of his or her skills, qualifications, knowledge and experience, competent to perform the duties he or she proposes to perform; (f) is appointed under the Agency Agreement; and (g) agrees to comply with the conditions of the Agency Agreement. 10.5 Additional information DRWDOCS\CC>ULTSI\26019.13
