WA - A SS ES SM EN T OF SI TE C O N T A M IN A T IO N Western Australia Report to the NEPC on the implementation o f the National Environment Protection (Assessment o f Site Contamination) Measure fo r Western Australia by the Hon Dr Judy Edwards MLA, M inister fo r the Environment fo r the reporting year ended 30 June 2003 PART 1 - GENERAL INFORMATION________ (R efer to page 228) PART 2 - IMPLEMENTATION OF THE NEPM, AND ANY SIGNIFICANT ISSUES Legislative, reg u la to ry an d adm in is tra t iv e f ra m ew o rk W estern A ustralia (WA) has drafted the C ontam inated Sites B ill (2002) around the princip les o f the N EPM , and containing provisions for the m aking o f guidelines, w hich w ill be used for im plem enting the elem ents o f the N EPM . This leg islation was in troduced to P arliam ent in 2002, and is curren tly before the upper H ouse o f Parliam ent for debate. It is an tic ipated that the Bill w ill be passed late in 2003. Im p le m e n ta t io n activit ies The D epartm ent o f Environm ent in WA has developed and released a guideline series en titled the C ontam inated Sites M anagem ent Series that contains eleven guidelines for the assessm ent and m anagem ent o f contam inated sites. The firs t gu idelines o f th is series were released in 2 0 0 0 , and further guidelines are added as the need for ex ternal guidance on the m anagem ent o f contam inated sites is identified . The guidelines comprise adm inistrative and technical guidelines. The adm in istrative gu idelines provide gu idance on the p rovisions o f the C ontam inated Sites B ill. The technical guidelines u tilise the N EPM and its schedules ( B l - 1 0 ) and have been developed to further refine the protocols established under the NEPM . One o f the gu idelines, en titled A ssessm ent levels for soil, sedim ent and w ater incorporates the Investigation levels as de ta iled in the N EPM . However, due to the im portance o f g roundw ater resources in WA, this guideline is currently under review to replace the NEPM E cological Investigation Levels w ith gu idelines from E nvironm ent Canada. The D epartm ent o f Environm ent is seeking CSIRO advice on the app licab ility o f the C anadian gu idelines for the WA setting. Im p lem en ta t io n s u m m a ry an d evalua tion W estern A ustralia has u tilised the m ethodology established under the N EPM to prepare and im plem ent a regu lato ry and adm in istrative fram ew ork for the assessment and management o f contaminated sites in WA. PART 3 - A S S E S SM E N T OF NEPM EFFECTIVENESS_____________________________ The methodology contained within the NEPM have been used in the p reparation o f the C ontam inated Sites M anagem ent S eries. A doption o f the m ethodologies obtained w ith in the C ontam inated Sites M anagem ent Series and the N EPM by proponents and practitioners has led to a consistent m ethodology for the assessm ent o f sites.
