The com prehensive range o f program s and strateg ies con tained in A ction for A ir include strateg ies d irected a t p ro tec ting air quality through con tro ls on m otor veh icle em issions. The N SW E nvironm ent P ro tec tion A uthority (EPA) and N SW R oads and T raffic A u thority (RTA) are the two agencies responsib le fo r the m anagem ent o f d iesel veh icle em issions and im plem entation o f the D iesel N EPM in NSW. The Protection o f the Environment Operations Act 1997 (N SW ) and, under the A ct, the P rotection o f the E nvironm ent O perations (C lean A ir) R egulation 2002 (N SW ), provide the regu la to ry basis fo r action to address em issions from the in -service diesel fleet. The Regulation underpins the NSW Smoky Vehicle Program, a key elem ent o f N SW D iesel N EPM im plem entation. Specifically, the R egulation prohibits excessive visible sm oke em issions from veh icles and tam pering w ith f ilte r con tro l equipm ent. W arnings, fines, inspection no tices and defective veh icle no tices can be issued to ow ners o f excessively sm oky veh icles repo rted under the Sm oky V ehicle Program , and repair o f veh icles is som etim es required . In som e serious cases, and for som e repeat offenders, p rosecu tions are launched by the EPA. The in -serv ice d iesel vehicle em ission standards established in NRTC regulations provide the benchm ark against w hich the em issions perform ance o f N SW diesel veh icles is assessed. In th is way, the in -serv ice standards play an important role in program development. Im p lem en ta t io n activities A ir quality is a m ajor env ironm ental issue fo r some parts o f NSW, p articu larly in Sydney and the G reater M etropolitan R egion (G M R ). T his area is com prised by Sydney, N ew castle and W ollongong and contains approx im ately 70% o f the S ta te s population . Local topography is p a rticu larly im portan t in th is region as the location o f hum an se ttlem ents in natural basins m akes them vulnerable to poor a ir quality under certain w eather conditions. M o to r vehicles emissions est im ates M otor vehicles contribute approxim ately 82% o f oxides o f n itrogen (N O x), to the atm osphere in the Sydney R egion and up to 30% o f partic les (as P M 10). D iesel veh icles m ake a d isproportiona te ly h igh con tribu tion to air po llu tion from the transport sector even though they constitu te only approxim ately 8.9% o f the vehicle fleet in N SW and 7% o f the flee t bo th in the Sydney region and in the GMR. EPA modelling o f m otor vehicles em issions estim ates that in the year 2 0 0 0 , diesel vehicles con tribu ted approxim ately 22% o f N O x and 51% o f P M 10 em issions from all vehicles in the GMR. E m issions from d iesel veh icles are p red ic ted to fall from 2005 to 2010 w ith the m ore stringent Euro diesel veh icle em issions standards from 2 0 0 2 , and w ith low sulphur and ultra-low sulphur diesel from January 2003 and January 2006, respectively. Diesel vehicle fleet p rofile N SW RTA reg istration data show s that diesel vehicles co nstitu ted 8.9% o f the N SW fleet a t 30 M arch 2003. Table 1 below gives detail. L igh t com m ercial vehicles (LC V s) constitu te the largest sector o f the diesel fleet at 48% . H eavy trucks (rig id d iesel veh icles) account for 27% o f the d iesel fleet. Together, these categories accoun t fo r 75% o f the to tal diesel fleet in NSW.
