DEBATES - Tuesday 23 May 1995 M r PERRON: I am talking about the bill before us. Proposed section 3(l)(eb) includes a list of the functions of the Director of Public Prosecutions which are what I would call loosely judicial-type functions - that is, actions of the DPP that relate to the conduct of matters connected with judicial proceedings. In other words, that means when he is exercising his statutory ability to make decisions on matters that he is there to decide on as distinct from the way he may cause difficulties for people irrespective of his decisions. M r Bell: Wait on. The Ombudsmans report talks about somebody who had been in touch with him because the person was offended by the DPPs decision in respect of proposed section 3(l)(eb)(i) - the decision to institute judicial proceedings. M r PERRON: However, we are saying that decisions to institute proceedings should not be reviewable by a person who does not have the qualifications of the DPP where there are other appeal processes. I will conclude there, because I have covered all of those points. I have not been able to read section 28(2) or whatever it was that the honourable member said that I should read on my feet.
