17. 1. That the Code of Conduct be amended to give real and useful examples (including an example of an MVR transaction at a remote police station) of conflict of interest (and potential conflict of interest) to assist members in making that assessment 2. That members responsible for recruitment and other training be given an outline of the conflict of interest issues raised in this complaint and that those members be required to-check and update course content to reflect those issues. 3. That the Commissioner issue a guideline to all members cautioning against private activities of this nature where such activities could impact on the credit of the Northern Territory Police Force. 4. False declaration of MVR documents by yourself The JRC notes that in the course of this matter, you lodged a Notice of Disposal with the MVR at Katherine on 11th March 2003 advising that you had sold the vehicle to Mr Rockman yourself for $17,000 and that this was falsely declared. You also rendered a tax invoice to the Kurra Corporation in the same terms. You did this in an attempt to right the wrong you believed you were done. CONCLUSION The JRC notes that disciplinary proceedings under the Police Administration Act have been initiated in the following terms: 1. That S/Constable Westra Van Holthe has failed to transfer his registration over within 14 days of purchase in breach of the Code of Conduct - the JRC finds that the allegation is sustained and disciplinary action under the Police Administration Act has been initiated in those terms. 2. That S/Constable Westra Van Holthe has falsely declared the sale date on the Application to Register/Renew/Transfer a Vehicle document in breach of the Code of Conduct - the JRC finds that the allegation is sustained and disciplinary action under the Police Administration Act has been initiated in those terms. 3. That S/Const Westra Van Holthe has falsely declared the sale date on the Notice of Disposal form in breach of the Code of Conduct - the allegation is sustained and disciplinary action under the Police Administration Act has been initiated in those terms. 4. That S/Const Westra Van Holthe has acted contrary to the Code of Conduct and committed a breach of discipline by engaging in improper conduct in relation to his involvement in the sale of the vehicle - the allegation is sustained and disciplinary action under the Police Administration Act has been initiated in those terms. 5. That Brevet Sergeant Wenn may have unlawfully provided personal information relating to yourself from the MVR (MOVERS) computer database without authority in breach of the Code of Conduct - the JRC finds that the allegation is sustained and disciplinary action under the Police Administration Act has been initiated in those terms.
