- 29 ( 4) Headings and marginal notes have been inserted for guidance only and shall not be part of this Lease. ( 5) Any covenant or agreement other than a covenant or agreement to pay money on the part of two or more persons shall be deemed to bind them jointly and severally. 2. Lessee's Covenants The lessee covenants with the Lessor that the Lessee shall (a) pay the Rent to the Lessor at the times and in the manner set forth in Schedule 1 hereto; (b) not use the Demised Premises or permit the Demised Premises to be used for any purpose other than the permitted Use or for a purpose approved under the Town Plan; (c) at all times - during the term of the Lease maintain, repair and keep in repair the Demised Premises; (d) pay and discharge all rates, taxes, assessments, duties, impositions and outgoings imposed or charged during the term upon or in respect or the Demised Premises or upon the owner or occupier in respect thereof or payable by either in respect thereof; (e) not assign this Lease or any part thereof without the written consent of the Lessor which consent will not be unreasonably refused; (f) not mortgage, charge or otherwise encumber this lease without the prior written approval of the lessor which approval shall not be unreasonably withheld if the mortgagee agrees that in the event that he exercises his power of sale he will not dispose of the leased property or any part of it to a person other than a person approved by the lessor which approval shall not be unreasonably withheld if such person agrees to be bound by the terms of this lease and is a person who in the opinion of the lessor is capable of adequately performing the terms of this lease; (g) on request provide the Lessor with the names or any persons to whom the Demised Premises or any part thereof are let or sub-leased or who are permitted to occupy the Demised Premises or any part thereof; (h) not make or cause to be made any structural or other alterations or additions to the Demised Premises or any part thereof without the prior written consent
