. ~ - 33 5. Indemnity and Release (1) The Lessee agrees that the occupation and use of the Demised Premises by the Lessee or its sub-tenant or licensee is at the risk of the Lessee. ( 2) The Lessee hereby releases the Lessor its servants or agents from all actions, claims and demands or every kind whatsoever and from all liability howsoever arising for loss, damage, death, injury costs or expenses of whatsoever kind which arise from, in or upon the Demised Premises or from their occupation or use and the Lessee hereby indemnifies and agrees to keep indemnified the Lessor against any such liability. 6. Reservations This Lease is subject to the Lessor reserving to itself or persons claiming through or under it the right to (a) install, use, operate, repair, alter, remove or replace pipes, wires, or other conduits or other facilities through, under or over the Demised Premises for the purpose of providing water, sewerage, drainage, electricity, telephones or other services in the Town or outside of it; and (b) enter at any time upon the Demised Premises and any improvements erected thereon for the purpose specified in paragraphs (a) but always taking reasonable action to ensure as little disturbance as possible to the Lessee's use and possession of the Demised Premises. 7. Termination (1) The Lessor may terminate this Lease upon the happening of any of the following events (a) if default is made by the Lessee in the performance or observance of any term or condition of Clause 2 of this Lease and as a result of that default the Director gives notice under or exercises his power to terminate the head Lease pursuant to either paragraphs (b) or (c) of sub-Clause 28 ( 1) of the Head Lease by notice to the Lessee, such termination being on a date not more that seven ( 7) days prior to the termination of the Head Lease; (b) if default is made by the Lessee in the performance or observance of any term or condition of this Lease, and where such default is capable of remedy such default is not
