LAWRIE Minister for Planning and Lands 10/51 Commercial Passenger (Road) Transport Act DETERMINATION OF MAXIMuM FARES AND CHARGES FOR TAXIS I, DELIA PHOEBE LAWRIE, the Minister for Infrastructure and Transport: (a) under section 26(1) of the Commercial Passenger (Road) Transport Act and with reference to section 43 of the Interpretation Act, revoke the determination of maximum fares and charges for the hire or use of taxis for the Alice Springs area, Darwin area, Katherine area, Nhulunbuy area and Tennant Creek area dated 22 August 2007 and published in Gazette No. S39 of 10 December 2007; and (b) under section 26(1) of the Commercial Passenger (Road) Transport Act, determine the maximum fares and charges for the hire or use of taxis for the Alice Springs area, Darwin area, Katherine area, Nhulunbuy area and Tennant Creek area as set out in the Schedule. In this Schedule: Alice Springs area means the area within the town of Alice Springs. Darwin area means the area within the town of Darwin comprised of: (a) the Legislative Assembly electoral divisions of Blain, Brennan, Casuarina, Drysdale, Fannie Bay, Jingili, Karama, Millner, Nelson, Nightcliff, Port Darwin, Sanderson and Wanguri; and (b) the part of the Legislative Assembly electoral divisions of Goyder within the boundary commencing at the intersection of the Stuart Highway with Lowther Road, then westerly along Lowther Road to virginia Road, then southerly along virginia Road to the Elizabeth River, then southeasterly along the Elizabeth River to Bees Creek Road, then southerly along Bees Creek Road to the intersection with Jenkins Road, then easterly along Jenkins Road and Goode Road to the intersection with Trippe Road, then northerly along Trippe Road to the intersection with the Arnhem Highway, then westerly along the Arnhem Highway to the Stuart Highway, then northerly along the Stuart Highway to the intersection with Lowther Road. Katherine area means the area within a 5 kilometre radius of the Post Office at Katherine. Nhulunbuy area means the area within a 13 kilometre radius of the Post Office at Nhulunbuy. Tennant Creek area means the area within a 5 kilometre radius of the Post Office at Tennant Creek. Part 2 Maximum fares and charges for areas other than Tennant Creek area 2. This Part applies to each of the following areas (an applicable area): (a) Alice Springs area; (b) Darwin area; (c) Katherine area; (d) Nhulunbuy area. 3. In this Part: distance travelled means the rate expressed in dollars per kilometre that may be charged for the distance travelled for a journey. flagfall means the hire charge for a journey. special journey means a journey for a wedding, funeral or other special occasion where the hiring includes waiting until the wedding, funeral or other special occasion has taken place and further carriage of the hirer immediately afterwards. Tariff means Tariff 1, 2, 3, 4, 5 or 6. Tariff 1, for an applicable area, means an amount specified in the table for that area for a journey: (a) made wholly within that area; and (b) starting on a weekday within the period starting from and including 6 am and ending immediately before 6 pm; and (c) for which a multiple hiring rate or high occupancy rate does not apply. Tariff 2, for an applicable area, means an amount specified in the table for that area for a journey: (a) made partly within that area that starts at any time on any day, or made wholly within that area that starts: (i) on a day other than a weekday; or
